European Court of Justice rules that French feed-in tariff is state aid #solar

The European Court of Justice (ECJ) has determined that French feed-in tariffs are based on state aid, in a ruling on the Vent De Colère case. The European Union sets strict limits on state aid, and this will allow the EU jurisdiction over French renewable energy policy. This is the second time in December 2013 that the European Union has decided that a feed-in tariff is state aid, following a European Commission decision to investigate feed-in tariff surchage exemptions in Germany. These decisions bear a curious relationship to the 2001 PruessenElektra case, where German feed-in tariffs were ruled not to be state aid. The Vent De Colère ruling over French feed-in tariffs does not overturn PruessenElektra, but as in the European Commission decision the ECJ states that the underlying circumstances are different. “Power grab” German Law Professor, Writer and renewable energy...
